THE “SUMMER 2024 SF GIANTS TICKET GIVEAWAY” OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER, WIN, OR CLAIM A PRIZE.

SPONSOR. The official sponsor (“Sponsor”) of the Summer 2024 SF Giants Ticket Giveaway(“Sweepstakes”) is San Francisco Fire Credit Union (“SF Fire CU”), located at 3201 California Street, San Francisco, California 94118.

ELIGIBILITY. To participate in the Sweepstakes, you must be a natural person resident of the State of California, age 18 or over.  Employees and officials of SF Fire CU, Mint Advertising, their affiliates, subsidiaries, and members of their immediate families or households, are not eligible. Void where prohibited. SF Fire CU reserves the right to require proof of eligibility prior to distributing any prize, and any person who does not meet the eligibility criteria will be disqualified. For purposes of this Sweepstakes, “immediate family member” includes spouse/domestic partner, parent, child, legal guardian/dependent, or sibling.

HOW TO ENTER. Eligible individuals may enter the Sweepstakes one of the following two (2) methods:

(1)  During the Sweepstakes Period, SF Fire CU will occasionally post about the Sweepstakes on its official Facebook® page (https://www.facebook.com/sffirecu) or Instagram® page (https://www.instagram.com/sffirecu) (“Sweepstakes Post”). An eligible individual will be automatically entered into the Sweepstakes (“Entry”) each time they leave a comment and tag a friend on a Sweepstakes Post during the Sweepstakes Period. There is no limit to the number of times an eligible individual may enter using the above method.

(2)  An eligible individual may enter without becoming a member of SF Fire CU by mailing a 3” x 5” index card (or similar) to SF Fire CU containing the Promo Code SFGFFAN, their first and last name, address (no P.O. box, please), telephone number, email address, and a brief statement of how they are eligible for membership in SF Fire CU. The submission must be mailed to SF Fire Credit Union, Attention: Marketing, 3201 California Street, San Francisco, California 94118 and received on or before the end of the Sweepstakes Period. An eligible individual will receive one (1) automatic entry for each separately mailed Entry submission. There is no limit to the number of times an eligible individual may enter using the above method.

All Entries and Entrants are subject to verification of eligibility by Sponsor. In the event that the eligibility of an Entry or Entrant cannot be established, or if any Entry is determined by Sponsor to be in violation of these Official Rules, Sponsor reserves the right, in its sole discretion, to disqualify the Entry.

SWEEPSTAKES PERIOD. The Sweepstakes opens on July 22, 2024, at 12:00 a.m. PST and closes on August 2, 2024, at 11:59 p.m. PST (“Sweepstakes Period”).

GRAND PRIZE. A total of eight (8) Grand Prizes will be awarded. Limit one prize per person. Each Grand Prize shall consist of two (2) Club Level tickets to the SF Giants Baseball game on August 9, 2024 at Oracle Park in San Francisco, California. Each Grand Prize is valued at approximately $200 ($100 per ticket plus fees).

Prizes have no cash equivalent value and may not be exchanged for cash. Prizes and Entries are non-transferable. Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value. Alternative prizes are not available except at the sole discretion of Sponsor. Grand Prize Winner is solely responsible for any additional costs that may be incurred in connection with attending the event, including, but not limited to, transportation to or from the event, parking, food and beverage, or overnight accommodation.

WINNER SELECTION. A total of two (8) Grand Prize Winners will be selected from all eligible Entries by random drawing at approximately 12:00 p.m. PST on August 5, 2024. All Grand Prize Winners are subject to verification of eligibility by Sponsor. In the event that the eligibility of a Grand Prize Winner cannot be established, Sponsor reserves the right, in its sole discretion, to disqualify the Entry, in which case the prize will be deemed forfeited and another Grand Prize Winner will be selected by random drawing from among the remaining Entries. This process will be repeated as necessary until both Grand Prizes have been awarded and claimed.

ODDS OF WINNING. Odds of winning depend on the number of eligible Entries received as of the close of the Sweepstakes Period but are estimated at approximately 1:1,000.

WINNER NOTIFICATION. Grand Prize Winners will be notified via direct message (“DM”) through Facebook® or Instagram®, as applicable, and/or through such other contact information as provided by Entrant in connection with his or her Entry. Winners need not be present to win. A Grand Prize Winner will have forty-eight (48) hours from the time of initial notification to respond and claim the Grand Prize. Sponsor will make at least three (3) attempts to contact a Grand Prize Winner during this time. If for any reason a Grand Prize Winner does not respond and claim the Grand Prize within forty-eight (48) hours after initial notification, the Grand Prize will be deemed forfeited and an alternative Grand Prize Winner will be selected. This process will be repeated as necessary until both Grand Prizes have been awarded and claimed. Confirmed Grand Prize Winners will be announced by Sponsor on the SF Fire CU website by 5:00 p.m. PST on August 5, 2024, or as soon thereafter as such Grand Prize Winner is confirmed.

TAX RESPONSIBILITY. All taxes in connection with participation in the Sweepstakes or the awarding or acceptance of any prize, and the reporting consequence thereof, are the sole responsibility of the prize winner.

ENTRY AND PRIZE LIMITATIONS. There is no limit to the number of Entries per person. Each Entrant is eligible to win no more than one prize. Once an Entrant has been awarded any prize, he or she will not be eligible to win any other prize. Duplicate Entries will not increase the chance of winning and will be discarded.

NO WARRANTY OR GUARANTEE. PRIZES ARE AWARDED “AS IS.” SPONSOR MAKES NO WARRANTIES OR GUARANTEE, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THIS SWEEPSTAKES OR THE PRIZES, AND SPECIFICALLY DISCLAIMS ALL SUCH WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES FOR MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR ANY PARTICULAR PURPOSE.

STATEMENT OF NON-AFFILIATION. By submitting an Entry and participating in this Sweepstakes, Entrant acknowledges and agrees that neither Sponsor, this Sweepstakes, nor any prize awarded hereunder, is in any way sponsored, endorsed, administered by, or associated with Meta, SF Giants, SFFD, Mint Advertising, or their affiliate entities.

WAIVER AND RELEASE. ENTRANT UNDERSTANDS AND AGREES THAT THE AWARD OF ANY PRIZE IS EXPRESSLY CONTINGENT UPON ENTRANT SIGNING A WAIVER AND RELEASE ACCEPTABLE TO SPONSOR CONFIRMING ENTRANT’S AGREEMENT TO BE BOUND BY THESE OFFICIAL RULES AND TO FULLY RELEASE AND HOLD HARMLESS SPONSOR, META, AND OTHER DESIGNATED PERSONS AS SET FORTH IN THESE OFFICIAL RULES, FROM ANY LIABILITY ARISING FROM, OR IN ANY WAY RELATED TO, ENTRANT’S PARTICIPATION IN THIS SWEEPSTAKES OR ACCEPTANCE OF ANY PRIZE THEREFROM. FAILURE TO EXECUTE A WAIVER AND RELEASE WILL RESULT IN THE FORFEITURE OF ANY PRIZE.

INDEMNIFICATION; LIMITATION OF LIABILITY. ENTRANT AGREES THAT SF FIRE CU AND ITS SUBSIDIARIES AND AFFILIATES, AND EACH OF ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS (“INDEMNIFIED PARTIES”) SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY CLAIMS, INJURIES, LOSSES OR DAMAGES OF ANY KIND RESULTING FROM: (A) ENTRANT’S PARTICIPATION IN THIS SWEEPSTAKES; (B) SPONSOR’S USE OF ANY ENTRY IN ACCORDANCE WITH THESE OFFICIAL RULES; (C) DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE SWEEPSTAKES; OR (D) ENTRANT’S ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE. ACCORDINGLY, ENTRANT HEREBY AGREES TO RELEASE, INDEMNIFY AND HOLD HARMLESS THE INDEMNIFIED PARTIES, AND EACH OF THEM, FROM AND AGAINST SAME.

RESERVATION OF RIGHTS. Violation of these Official Rules may result in immediate disqualification and forfeiture of any Entry and/or Prize. Sponsor reserves the right, in its sole discretion, to determine whether these Official Rules have been violated and to disqualify any Entry or Entrant it deems in violation of these Official Rules, or not in keeping with the spirit of the Sweepstakes, without notice. Sponsor reserves the right to terminate, suspend or amend the Sweepstakes, without notice, for any reason, including, without limitation, if Sponsor, in its sole discretion, determines that the Sweepstakes cannot be conducted as planned or that tampering, technical failure, or any other cause interferes with the administration, security, fairness, or integrity of the Sweepstakes. Automated entries (including but not limited to entries submitted using any bot, script, macro, or Sweepstakes entry or notification service), copies, forged entries, third party entries, entries by entities, facsimiles and/or mechanical reproductions are not permitted and will be disqualified.

Sponsor is not responsible for incorrect, inaccurate, illegible, incomplete, lost, damaged, late, misdirected, garbled, or mutilated Entry information or mail delivery. Sponsor is not responsible for human error; technical malfunction; lost or delayed data transmission; omission, interruption, deletion, line failure. or malfunction of any telephone network, computer equipment or software; power outage; the inability to access any website or online service; or any other error, human or otherwise.

FORCE MAJEURE. Sponsor reserves the right to terminate, suspend, reschedule, or amend the Sweepstakes upon the occurrence of acts or events beyond the Sponsor’s reasonable control, including, without limitation, a force majeure event that makes it illegal, impracticable, or impossible for Sponsor to proceed with the Sweepstakes, including, but not limited to: (a) acts of God; (b) fire, flood, earthquake, explosion or other disaster; (c) war, invasion, terrorist threats or acts, riot, or other civil unrest; (d) government order or law; (e) actions, embargoes, or blockades in effect on or after the date of this Agreement; (f) action or regulations by any governmental authority; (g) national or regional emergency; (h) medical epidemic, pandemic or outbreak; (i) strikes, labor stoppages or slowdowns, or other industrial disturbances (except those involving the employees or agents of the party seeking the protection of this clause); (j) shortage of adequate power or curtailment of transportation facilities; or (k) any other causes beyond the reasonable control of Sponsor.

PRIVACY; DATA COLLECTION; AND USE OF YOUR PERSONAL INFORMATION. Upon entering the Sweepstakes, Sponsor will collect an Entrant’s username and any other contact information Entrant has made public through the social medial platform (Facebook® or Instagram®) through which the Entry was submitted. For mailed Entries, Sponsor collects the contact information provided by Entrants with the Entry, including name, address, email, and telephone number. This information is collected for the sole purpose of administering this Sweepstakes, and it will not be used, reused, sold, or shared by Sponsor with any third party, except as necessary to administer the Sweepstakes. Except as prohibited by law, by entering the Sweepstakes or accepting any prize, each Entrant agrees to allow Sponsor to contact him or her through direct message (“DM”) using the social media platform through which Entrant entered the Sweepstakes, or through any other contact information collected by or provided to Sponsor, including by email and/or cellular telephone.

By entering the Sweepstakes or accepting any prize, Entrant agrees, authorizes, and grants Sponsor a perpetual, irrevocable, unconditional, nonexclusive license to photograph, record, videorecord, publish, use, and/or re-use Entrant’s name and/or likeness (“Image”) for any and all permissible business purposes of Sponsor, including, but not limited to, marketing and/or commercial purposes, without further consent or compensation. This authorization shall extend to Images in any medium, including, but not limited to print, digital, audiovisual, online, or otherwise. Entrant further consents to the editing and/or retouching of Images, or the use of such Images with other images, text, graphics, etc.

CHOICE OF LAW. The construction, validity, interpretation, and enforceability of these Official Rules, and/or the rights and obligations of Entrants or Sponsor shall be governed by and construed in accordance with the laws of the State of California.

SEVERABILITY. If any provision, clause, sentence, section, or other part of these Official Rules is held to be invalid, illegal, inapplicable, unconstitutional, contrary to public policy, void, or unenforceable in law or equity as to any person or circumstance, the remaining balance of these Official Rules shall remain in full force and effect.

All determinations of Sponsor are final. By participating in the Sweepstakes, Entrant accepts the decisions of Sponsor as final.
